Terms of service

These terms are an agreement between Flemming Consulting Group (“we”, “us”) and the organization that signs up to use KERIKS (“you”). By creating an account or sending a message through the service, you agree to them. If you are a person who received a message and you are reading this, the privacy policy explains what happens with your information; these terms are mostly about the organization that sent it.
What the service is
KERIKS lets you write one message with background notes, sends each recipient a private link, shows the message in the recipient’s language and preferred length, answers recipients’ questions using only the material you provided, collects the questions it cannot answer for your office, and reports back to you. The service is offered as a pilot and may change while we learn from it.
Your responsibilities
You confirm that you have the right to contact the people you add, that they have agreed to hear from you by text or email, and that you will honor any request to stop. You will only add contact details for adults. You are responsible for what you write: the announcement, the notes, and the answers your office adds. You will keep your sign-in details private and tell us if you think an account has been misused.
You will not use the service to send unsolicited commercial messages, to harass anyone, to send anything unlawful, or to send emergency alerts where lives depend on delivery. Text and email delivery can fail or be delayed for reasons outside our control.
The message assistant
Recipients’ questions are answered by an automated assistant that is instructed to use only your announcement, your notes and your office’s answers, and to pass anything else to your office. Every reply is labeled as automated. Adapted versions of your message (translated or shortened) are checked so that dates, times, amounts and other figures survive unchanged; when that check fails, the original text is shown instead. The assistant can still make mistakes. You should read the stored versions and the inbox, and you remain responsible for what your organization tells its people.
When a recipient shares something personal (grief, hardship, a request for prayer, a hint of self-harm), the assistant does not counsel them. It tells them a person will follow up and places the message on your “needs a personal call” list. Following up is your responsibility.
Your data
Your contacts, messages, notes and the questions you receive belong to you. We use them only to run the service for you, as described in the privacy policy. You can export or delete them by asking us. We may keep copies in backups for a limited time after deletion.
Fees
During the pilot the service is provided at no charge unless we agree otherwise in writing. If we introduce fees later, we will tell you in advance and you may stop using the service before they apply.
Ending the agreement
You can stop using the service and ask us to close your account at any time. We may suspend or close an account that breaks these terms, that appears to be misused, or if we discontinue the service; we will give reasonable notice where we can and let you export your data.
Limits on our liability
The service is provided as is, without warranties of any kind, to the extent the law allows. We are not liable for indirect or consequential losses, or for losses caused by delivery failures, by the content of your messages, or by a recipient’s reliance on an assistant’s answer. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim, or one hundred US dollars, whichever is greater.
Changes and law
We may update these terms; the new version applies from the date shown at the top, and we will tell account holders about material changes. These terms are governed by the laws of the State of [to be confirmed], United States, and any dispute will be heard in its courts.
